1. Acceptance of Terms

By using the website marketplacesoumission.ca (hereinafter "the Site"), operated by Agence Evo (hereinafter "we" or "Marketplace Soumission"), you agree to be bound by these terms of use. If you do not accept these terms, you must not use the Site or its services.

Using the quote request form, browsing the Site, or any interaction with our services constitutes full and complete acceptance of these terms.

2. Description of Service

Marketplace Soumission is a free matchmaking platform between residential homeowners and RBQ-licensed roofers in Quebec. Our service includes:

• Receiving roofing quote requests through an online form
• Satellite analysis of the roof to estimate area measurements
• Connecting the homeowner with 2 to 3 RBQ-licensed roofers in their area
• Follow-up on the request by email and/or phone

Marketplace Soumission acts strictly as an intermediary. We are not a construction contractor, a roofer, or a subcontractor. We do not perform any roofing work.

3. Conditions for Homeowners

3.1 Free Service

The quote request service is entirely free for homeowners. No fees are charged to receive roofer quotes.

3.2 Accuracy of Information

You agree to provide accurate and complete information in the quote request form, including your name, contact details, the property address, and the nature of the desired work. Inaccurate information could affect the quality of the quotes received.

3.3 No Price Guarantee

Marketplace Soumission does not guarantee any price, completion timeline, or quality of work offered by roofers. Quotes are prepared by roofers independently. It is your responsibility to compare quotes, verify RBQ licenses and insurance, and negotiate directly with the roofer of your choice.

3.4 No Obligation

Receiving quotes through Marketplace Soumission does not obligate you in any way to retain the services of a roofer. You remain free to accept or refuse any quote received.

4. Conditions for Roofers

4.1 RBQ License Required

Any roofer participating in the platform must hold a valid license from the Quebec Building Board (RBQ) in the appropriate subcategory for roofing work. Marketplace Soumission reserves the right to verify the validity of the license at any time.

4.2 Insurance

Each roofer must maintain current liability and professional insurance for the duration of their participation in the platform. Proof of insurance may be required at any time.

4.3 Lead Payments

Participating roofers agree to pay lead fees according to the terms agreed upon in their partnership agreement with Marketplace Soumission. Rates, payment conditions, and lead dispute policies are detailed in each roofer's individual agreement.

4.4 Quality and Professionalism

Roofers agree to provide professional service, respond to requests within a reasonable timeframe, and provide detailed and honest quotes. Marketplace Soumission reserves the right to remove any roofer who does not meet these standards.

5. Limited Liability

Marketplace Soumission acts exclusively as an intermediary between homeowners and roofers. Consequently:

• We are not responsible for the quality, price, timelines, or results of work performed by a roofer
• We are not a party to the contract between the homeowner and the roofer
• We do not guarantee the availability, reliability, or competence of any particular roofer
• We are not liable for direct, indirect, incidental, or consequential damages arising from the use of the service or work performed
• Our total liability, in all cases, is limited to the fees you paid to use the service (i.e., zero for homeowners)

6. Satellite Measurements

Marketplace Soumission uses satellite imagery tools to estimate the area and characteristics of your roof. These measurements are provided for informational purposes only and do not constitute an official survey.

• Satellite data is approximate and may vary from on-site measurements
• They do not replace a physical roof inspection by a professional
• Final roofer quotes may differ from satellite-based estimates
• Marketplace Soumission cannot be held responsible for inaccuracies in satellite measurements

7. Intellectual Property

All content on the Site, including text, images, logos, graphics, design, source code, and all other material, is the exclusive property of Marketplace Soumission / Agence Evo and is protected by Canadian and international intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or commercially exploit the content of the Site without our prior written authorization.

8. Modification of Terms

Marketplace Soumission reserves the right to modify these terms and conditions at any time. Modifications take effect upon publication on the Site. The last update date is indicated at the top of this page. Continued use of the Site after a modification constitutes acceptance of the modified terms.

For major modifications, we will make reasonable efforts to inform users by email or a visible notice on the Site.

9. Applicable Law and Jurisdiction

These terms and conditions are governed by the laws in force in the Province of Quebec and the federal laws of Canada that apply therein. Any dispute arising from these terms shall be submitted to the exclusive jurisdiction of the courts of the Province of Quebec, District of Montreal.

10. Severability

If any provision of these terms is found invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.
